Section 02
Notification Requirements (17 U.S.C. § 512(c)(3))
If you believe that any material accessible on or from our website or services infringes your copyright, you may request removal of that material by submitting a written notification to our designated agent that includes substantially all of the following elements. Your notice will not be considered valid if it does not include all six (6) required elements. To help prevent abuse, please review the requirements carefully before submitting your notice.
Section 03
What to Include in Your Notice
A proper DMCA notification must include each of the following six elements. Missing items may delay or prevent us from acting on your notice.
- 1. Authorized Signature — A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright’s exclusive right that is allegedly infringed.
- 2. Identification of the Copyrighted Work — Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
- 3. Identification of the Infringing Material — Identification of the material that is claimed to be infringing or to be the subject of infringing activity, with information sufficient to permit us to locate the material (such as the URL of the page, the in-game item or asset ID, the username of the alleged infringer, or a screenshot and clear timestamp).
- 4. Contact Information — Your contact information — including your full legal name, mailing address, telephone number, and email address — so that we may reach you regarding your notice.
- 5. Good-Faith Statement — A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- 6. Accuracy and Perjury Statement — A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or are authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.
Section 04
How We Respond
Upon receipt of a valid written notification that substantially complies with the six (6) elements described above, Clawtious Games will, in appropriate circumstances and at our discretion: (a) remove or disable access to the allegedly infringing material; (b) notify the user, account holder, or content creator who posted or uploaded the material (when applicable) that we have removed or disabled access to it; and (c) take reasonable steps to inform the affected party of the right to submit a counter-notification as described in Section 05 below. We may, at our sole discretion, terminate the accounts of repeat infringers in accordance with our repeat-infringer policy.
Section 05
Counter-Notification
If you believe that material you posted or uploaded was removed (or access to it was disabled) as a result of a mistake or misidentification, you may submit a written counter-notification to our designated agent. A valid counter-notification must include:
- Your Signature — Your physical or electronic signature.
- Identification of the Material — Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access to it was disabled.
- Perjury Statement — A statement, made under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled.
- Consent to Jurisdiction — Your name, mailing address, telephone number, and email address, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which Clawtious Games may be found), and that you will accept service of process from the person who provided the original notification or an agent of that person.
